Kennedy Jr. and Children\u2019s Health Defense (CHD) have the legal right to sue the Biden administration for pressuring tech giants to censor their social media posts.<\/p>\n\n\n\n<p>The judgment came less than a month after a federal appeals court declined to rule on a<a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/2.14.2024-Memorandum-Ruling-on-PI.pdf\"> preliminary injunction<\/a> prohibiting the administration from coordinating with social media companies until the district court decided the plaintiffs\u2019 standing.<\/p>\n\n\n\n<p>Standing is the <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/legal\/\">legal<\/a> doctrine that requires plaintiffs to show they have suffered direct and concrete injuries and that those injuries could be resolved in court in order to sue.<\/p>\n\n\n\n<p>Commenting on Tuesday\u2019s ruling in Kennedy v. Biden, Kim Mack Rosenberg, CHD general counsel, said that the U.S. District Court for the Western District of Louisiana \u201creached what we believe is the correct conclusion with respect to standing for CHD and Mr. Kennedy.\u201d<\/p>\n\n\n\n<p>Perhaps even \u201cmore importantly,\u201d she told <a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a>:<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"506\" height=\"882\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/10\/soul-is-in-our-blood.jpg\" alt=\"\" class=\"wp-image-5084\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/10\/soul-is-in-our-blood.jpg 506w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/10\/soul-is-in-our-blood-172x300.jpg 172w\" sizes=\"auto, (max-width: 506px) 100vw, 506px\" \/><\/figure>\n\n\n\n<p>\u201cJudge Terry Doughty carefully and clearly analyzed the law and facts and applied the framework from the U.S. Supreme Court\u2019s recent decision in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-411_3dq3.pdf\">Murthy v. Missouri<\/a> regarding standing. The court also firmly found in plaintiffs\u2019 favor that plaintiffs had not waived \u2014 and indeed had affirmatively raised \u2014 direct <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/censorship-surveillance\/\">censorship<\/a> claims in addition to listener claims.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#x1f4e3; GREAT NEWS!<br>Judge Terry Doughty of the Western District of Louisiana has found that <a href=\"https:\/\/twitter.com\/RobertKennedyJr?ref_src=twsrc%5Etfw\">@RobertKennedyJr<\/a>, CHD and Connie Sampognaro have standing in the lawsuit Kennedy v. Biden to continue our case in the Fifth Circuit Court of Appeals.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"480\" height=\"480\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-16.png\" alt=\"\" class=\"wp-image-4593\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-16.png 480w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-16-300x300.png 300w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-16-150x150.png 150w\" sizes=\"auto, (max-width: 480px) 100vw, 480px\" \/><\/figure>\n\n\n\n<p>This means the Biden-Harris\u2026<\/p>\n\n\n\n<p>\u2014 Children\u2019s Health Defense (@ChildrensHD) <a href=\"https:\/\/twitter.com\/ChildrensHD\/status\/1826030295239327782?ref_src=twsrc%5Etfw\">August 20, 2024<\/a><\/p>\n<\/blockquote>\n\n\n\n<p><strong>Facebook admitted suppressing truthful CHD social media posts<\/strong><\/p>\n\n\n\n<p>In his decision, Doughty summarized the evidence, outlining a series of specific instances where Kennedy and CHD were censored.<\/p>\n\n\n\n<p>He also reviewed the three requirements for \u201cstanding,\u201d which are that a plaintiff must show that they suffered an injury, that the injury is traceable to the defendant\u2019s actions and that it can be redressed through a favorable decision.<\/p>\n\n\n\n<p>CHD CEO Mary Holland said Doughty found that the government\u2019s conduct is traceable to direct statements and instructions to social media platforms, including Facebook, Instagram and YouTube.<\/p>\n\n\n\n<p>\u201cFurther, the judge found that a preliminary injunction, which mandates that the government stop censoring plaintiffs through social media, would redress their injuries,\u201d Holland said.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"752\" height=\"589\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/05\/media-and-control-of-the-mind.jpg\" alt=\"\" class=\"wp-image-2377\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/05\/media-and-control-of-the-mind.jpg 752w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/05\/media-and-control-of-the-mind-300x235.jpg 300w\" sizes=\"auto, (max-width: 752px) 100vw, 752px\" \/><\/figure>\n\n\n\n<p>Doughty wrote that Kennedy and CHD \u201cwere in positions contrary to Government positions on <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\">COVID-19<\/a>, including <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fauci-defends-covid-policies-lawmakers-house-select-subcommittee-hearing\/\">mask mandates<\/a>, <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fbi-questioned-employee-views-covid-vaccine-mandates-security-clearance\/\">vaccine mandates<\/a>, <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fauci-ignored-covid-vaccine-injuries-emails-chd\/\">vaccine injuries<\/a>, <a href=\"https:\/\/childrenshealthdefense.org\/defender\/homeland-security-pandemic-lockdowns-george-w-bush\/\">lockdowns<\/a>, etc.,\u201d that Kennedy was identified by the Center for Countering Digital Hate as part of the so-called \u201c<a href=\"https:\/\/childrenshealthdefense.org\/defender\/disinformation-dozen-funding-ties-hollywood-corporate-dems\/\">Disinformation Dozen<\/a>,\u201d and that CHD was named as a tool for spreading \u201canti-vaccine messages.\u201d<\/p>\n\n\n\n<p>Doughty also reviewed a series of meetings and emails between the White House and Twitter and Facebook, which occurred throughout 2021, in which those companies agreed to de-amplify, place warnings on or fully censor posts containing so-called \u201cvaccine misinformation,\u201d regardless of whether the information was true.<\/p>\n\n\n\n<p>For example, in one email Clark Humphrey, a member of the Biden administration\u2019s COVID-19 response team, requested Twitter remove one of Kennedy\u2019s tweets. The tech giant complied.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"462\" height=\"255\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2022\/11\/image-38.png\" alt=\"\" class=\"wp-image-1440\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2022\/11\/image-38.png 462w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2022\/11\/image-38-300x166.png 300w\" sizes=\"auto, (max-width: 462px) 100vw, 462px\" \/><\/figure>\n\n\n\n<p>\u201cFacebook admitted that although the CHD\u2019s posts did not violate its policies, it would suppress content that originated from CHD,\u201d Doughty wrote.<\/p>\n\n\n\n<p>He cited reports written by organizations, such as the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/twitter-files-virality-project-covid-misinformation\/\">Virality Project<\/a>, which named Kennedy and CHD specifically, flagging them with \u201ctickets\u201d to report COVID-19 misinformation to the social media giants.<\/p>\n\n\n\n<p>He also cited the fact that Kennedy\u2019s Instagram account was suspended and CHD continues to be deplatformed from Instagram, Facebook and YouTube \u2014 showing that CHD faces ongoing injury, a requirement for standing.<\/p>\n\n\n\n<p>\u201cThere is not much dispute that both Kennedy and CHD were specifically targeted by the White House, the Office of Surgeon General, and CISA [Cybersecurity and Infrastructure Security Agency], and the content of Kennedy and CHD were suppressed,\u201d he wrote.<\/p>\n\n\n\n<p>Given censorship of the Donald Trump presidential campaign on social media, and evidence presented in a <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/8.1.2024-Filed-Exh.-2-Dec-of-Brigid-Rasmussen.pdf\">declaration by Brigid Rasmussen<\/a>, the chief of Kennedy\u2019s presidential campaign, stating that <a href=\"https:\/\/whoisbobbykennedy.com\/\">content favorable to the campaign<\/a> had been censored on social media, Doughty ruled that Kennedy faces a \u201csubstantial risk\u201d that government defendants will restrict his speech in the future.<\/p>\n\n\n\n<p>Doughty ruled that the third plaintiff in the case, Connie Sampognaro, a Louisiana healthcare professional, who argued she was deprived of the \u201cright to listen\u201d to censored organizations did not have standing. Doughty said Sampognaro did not show specific instances of content moderation that caused her harm.<\/p>\n\n\n\n<p><strong>\u2018Undisputed that CHD has satisfied its burden of showing injury\u2019<\/strong><\/p>\n\n\n\n<p>In June, the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/supreme-court-murthy-missouri-ruling-biden-administration\/\">Supreme Court struck down<\/a> a similar injunction against the Biden administration in a related case, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-411_3dq3.pdf\">Murthy v. Missouri<\/a>.<\/p>\n\n\n\n<p>The court ruled the plaintiffs \u2014 two states and five social media users \u2014 did not have standing because they couldn\u2019t show \u201cspecific causation\u201d for any instance of content moderation tied to the government.<\/p>\n\n\n\n<p>The court also said the plaintiffs couldn\u2019t demonstrate a substantial risk that \u201cin the near future they will suffer an injury that is traceable to a Government defendant and redressable by the injunction they seek.\u201d<\/p>\n\n\n\n<p>The <a href=\"https:\/\/childrenshealthdefense.org\/defender\/rfk-jr-chd-win-injunction-landmark-censorship-case-biden-administration\/\">injunction issued in Kennedy v. Biden<\/a> was granted on Feb. 14 by Doughty, who also issued a stay until 10 days after the Supreme Court ruled on the injunction in Murthy v. Biden.<\/p>\n\n\n\n<p>After the Supreme Court overturned the Murthy v. Missouri injunction, the Biden administration <a href=\"https:\/\/childrenshealthdefense.org\/defender\/biden-administration-emergency-motion-kennedy-v-biden\/\">appealed the injunction<\/a> in Kennedy v. Biden to the 5th Circuit U.S. Court of Appeals, citing the same argument they used in Murthy v. Missouri \u2014 that the plaintiffs lacked standing.<\/p>\n\n\n\n<p>The 5th Circuit sent the case back to the District Court to rule on standing. In its ruling yesterday, <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/Kennedy-v-Biden-Standing.pdf\">Doughty wrote<\/a>:<\/p>\n\n\n\n<p>\u201cThis Court finds that there is significant evidence showing Kennedy was directly censored in the past, and there is likely a substantial risk that Kennedy\u2019s content will be restricted in the future because of the actions of at least one of the Government Defendants. \u2026<\/p>\n\n\n\n<p>\u201cIt is undisputed that CHD has satisfied its burden of showing injury in fact for much of the same reasons that Kennedy has.\u201d<\/p>\n\n\n\n<p>Only one plaintiff needs to have standing for a case to move forward. It might be someone you meet but we form our perceptions from information received. So the reason we don&#8217;t have free debate is because the official narratives do not stand up to scrutiny even the mildest scrutiny and thus if you had an open debate then the official narrative will be all over the floor so what do you do if you control the global media. If you control Silicon Valley indeed you created it you make sure you don&#8217;t have that debate and you do that by censorship and I would make this point too that censorship is not an expression of power.<br>P people with real power people with self-security they don&#8217;t want to censor anybody People who are confident that what they say will stand up to scrutiny don&#8217;t want to censor anybody they also realize that people having different opinions to you is the very Foundation of human freedom.<br>And once that&#8217;s gone it&#8217;s over there is no Freedom if you have a narrative you know won&#8217;t stand up to scrutiny if there is a perception you want to impose upon the people through suppression of the absence of any alternative then open debate and the free flow of information terrifies you so what we&#8217;re<br>looking at with this censorship through uh Silicon Valley the media and anything else that moves is not an expression of power it&#8217;s an expression of weakness.<br>It&#8217;s saying to you we know that our narrative won&#8217;t stand up so we&#8217;re not going to let it be um be challenged. It just don&#8217;t question anything um that&#8217;s how we got into this mess and it&#8217;s no that&#8217;s going to get us out of it no I&#8217;m not doing that no I&#8217;m not cooperating with my own enslavement.<br>That&#8217;s the way we&#8217;re going to get out of it and what happens with social media is it&#8217;s basically a<br>brawl it&#8217;s just a verbal keyboard brawl goes on uh but through that for intelligent people who are Discerning you can get nuggets of of Truth and information out that that um that circulates.<br>And you know let&#8217;s look at the Internet it&#8217;s it&#8217;s an interesting uh point because the internet now and social<br>media now is not how it started out. I remember when it started uh before it started even if I was doing an event or I was trying to get information out you stood in the street and you Ed leaflets out and then suddenly this internet came along and uh we had the free flow of information for a a while and for people<br>like me it was fantastic.<br><strong>But you know you put a fishing line out and then when you catch the fish you pull the fishing line in gotcha and this is what the internet really is I would s first of all Darpha the technological development AR of the Pentagon um claims credit openly for the creation of the internet and it&#8217;s military technology is based on right. <\/strong>So this was the thing number one you create the internet but you&#8217;ve got to pull the population in so you don&#8217;t censor you don&#8217;t censor you just um have the free fly of information you don&#8217;t like it but it&#8217;s necessary and as that unfolds more and more people come onto the internet oh yes oh God this is good you can say what you like and oh yeah it&#8217;s really great um and as more people use that as a form of communication so the other forms of communication the newspapers the television Etc they start to go down in their audience uh levels and their influence and <strong>the internet starts to dominate what you&#8217;re what you&#8217;re waiting for is that point we now where the internet dominates communication and a so infiltrated Human Society technologically via everything being connected to the internet that there&#8217;s no turning back gotcha okay.<\/strong><br>Now we&#8217;ll start censoring okay we don&#8217;t like censorship oh really how well she going to communicate apart from with us late last month the Supreme Court declined a request from a group of social media users and two states to limit the Biden administration&#8217;s efforts to urge social media companies to remove content deemed as misinformation. The Court ruled that the users and the states Louisiana and Missouri lacked the legal standing to pursue an injunction against the Biden Administration for its interactions with the social media platforms.<\/p>\n\n\n\n<p>The users had claimed that their freedom of speech was unconstitutionally infringed upon when their posts were removed or suppressed following pressure from Administration officials. report<\/a>, GARM\u2019s influence stems from the collective power of its members. \u201cWFA members represent roughly 90% of global advertising spend, or almost one trillion dollars annually,\u201d the document states.<\/p>\n\n\n\n<p>The alliance includes major players in the advertising industry:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Every major advertising agency holding company.<\/li>\n\n\n\n<li><a href=\"https:\/\/www.groupm.com\/about\/\">GroupM<\/a>, the world\u2019s largest media buying agency, on its Steer Team.<\/li>\n\n\n\n<li>Four large corporations \u2014 Unilever, Mars, Diageo, and Procter &amp; Gamble \u2014 that together spend billions annually on advertising.<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/judiciary.house.gov\/media\/press-releases\/how-worlds-biggest-brands-seek-control-online-speech\">GARM\u2019s Steer Team<\/a>, which acts as a board of directors, is closely involved in day-to-day operations. The initiative reports to the WFA Executive Committee, which includes representatives from major corporations such as AB InBev, L\u2019Or\u00e9al, Nestl\u00e9 and IBM.<\/p>\n\n\n\n<p><a href=\"https:\/\/judiciary.house.gov\/sites\/evo-subsites\/republicans-judiciary.house.gov\/files\/evo-media-document\/2023-03-22-jdj-to-rakowitz-rajamannar-garm.pdf\">Robert Rakowitz<\/a>, GARM\u2019s initiative lead and co-founder, plays a central role in the organization\u2019s activities. The report cites internal emails in which Rakowitz expressed views on free speech, describing an \u201cextreme global interpretation of the US Constitution\u201d as problematic.<\/p>\n\n\n\n<p>GARM claims to focus on \u201ccontent monetization\u201d rather than \u201c<a href=\"https:\/\/childrenshealthdefense.org\/defender\/supreme-court-murthy-missouri-ruling-biden-administration\/\">content moderation<\/a>.\u201d However, the report argues that these areas are \u201cinextricably linked,\u201d suggesting that GARM\u2019s work effectively influences what content appears online.<\/p>\n\n\n\n<p>In Wednesday\u2019s <a href=\"https:\/\/www.youtube.com\/live\/vmUfdnECOpA\">congressional hearing on GARM<\/a>, Rep. The committee report cites several examples of GARM\u2019s alleged coordinated actions:<\/p>\n\n\n\n<p><strong>1. Twitter boycott after Elon Musk acquisition.<\/strong> Following <a href=\"https:\/\/childrenshealthdefense.org\/defender\/elon-musk-acquisition-twitter-takeover\/\">Musk\u2019s acquisition of Twitter<\/a> (now known as X) in October 2022, GARM allegedly orchestrated a boycott of the platform. According to the report, GARM recommended its members \u201cstop \u2026 all paid advertisement\u201d on Twitter in response to the takeover.<\/p>\n\n\n\n<p>Internal documents show that GARM held \u201cextensive debriefing and discussion around [Musk\u2019s] takeover of Twitter,\u201d providing opportunities for the boycott to be organized. The report claims that GARM later boasted about \u201ctaking on Elon Musk\u201d and noted that Twitter was \u201c80% below revenue forecasts\u201d as a result.<\/p>\n\n\n\n<p><strong>2. Pressure on Spotify over Joe Rogan podcast.<\/strong> In early 2022, GARM and its Steer Team allegedly pressured Spotify over content on<a href=\"https:\/\/www.cnn.com\/2021\/04\/27\/media\/joe-rogan-covid-vaccine-spotify\/index.html\"> Rogan\u2019s podcast<\/a>, \u201cThe Joe Rogan Experience.\u201d The report states that GARM members urged action against Spotify due to alleged misinformation on Rogan\u2019s show, particularly regarding<a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\"> COVID-19<\/a> vaccines after Rogan said that young, healthy people didn\u2019t need them.<\/p>\n\n\n\n<p>Rogan later featured<a href=\"https:\/\/childrenshealthdefense.org\/defender\/joe-rogan-robert-malone-interview-covid-vaccine\/\"> Dr. Robert Malone<\/a> on his podcast, which prompted GroupM to reach out to Spotify after musician <a href=\"https:\/\/childrenshealthdefense.org\/defender\/joe-rogan-musicians-threaten-remove-music-spotify\/\">Neil Young removed his content<\/a> from the platform in protest over vaccine-skeptical material.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>House Judiciary Report Shows I am Being Censored by the Largest Corporations in the World<br>GARM\u2019s Harm: How the World\u2019s Biggest Brands Seek to Control Online Speech<a href=\"https:\/\/t.co\/0beGN2j2f7\">https:\/\/t.co\/0beGN2j2f7<\/a> <a href=\"https:\/\/t.co\/bGN5xErwvA\">pic.twitter.com\/bGN5xErwvA<\/a><\/p>\n\n\n\n<p>\u2014 Robert W Malone, MD (@RWMaloneMD) <a href=\"https:\/\/twitter.com\/RWMaloneMD\/status\/1811166892498768143?ref_src=twsrc%5Etfw\">July 10, 2024<\/a><\/p>\n<\/blockquote>\n\n\n\n<p>Internal emails cited in the report show Rakowitz coordinating with member companies to formulate responses to Spotify. In one instance, he wrote that he \u201ccan\u2019t publicly advise all clients to do X \u2014 that gets us into hot water by way of anticompetitive and collusive behaviors.\u201d<\/p>\n\n\n\n<p><strong>3. Efforts to demonetize certain news outlets.<\/strong>&nbsp;The report alleges that GARM and its members discussed strategies to block certain news outlets, including Fox News, The Daily Wire and Breitbart News.<\/p>\n\n\n\n<p>An internal email from a GARM Steer Team member describes monitoring these outlets closely. The email states that as much as he \u201chated their ideology and bulls**t,\u201d his company \u201ccouldn\u2019t really justify blocking them for misguided opinion[s]\u201d but that it \u201cwatched them very carefully and it didn\u2019t take long for them to cross the line.\u201d<\/p>\n\n\n\n<p>The congressional committee argued that these coordinated actions if proven, could constitute illegal restraints of trade that harm consumers by limiting their choices and access to diverse viewpoints online.<\/p>\n\n\n\n<p><strong>GARM\u2019s influence on political content and elections<\/strong><\/p>\n\n\n\n<p>Through their content moderation efforts, GARM and its members attempted to influence political discourse and election outcomes \u2014 including pushing for coordinated action around the 2020 U.S. presidential election, according to the report.<\/p>\n\n\n\n<p>In an October 2020 email, Rakowitz suggested telling<a href=\"https:\/\/childrenshealthdefense.org\/defender\/rfk-jr-meta-censorship-who-is-bobby-kennedy-film\/\"> Facebook<\/a> it was \u201cat a crossroads for the platform and fence sitting on content curation and moderation\u201d and that it should apply its COVID-19 content moderation policies to election-related content.<\/p>\n\n\n\n<p>The report cites an instance of GARM members pressuring Facebook to label a then-President Donald Trump campaign advertisement as misinformation. When Facebook refused, citing its policy of not fact-checking political candidates\u2019 ads, Rakowitz allegedly described the decision as \u201chonestly reprehensible\u201d in an internal email.<\/p>\n\n\n\n<p>The report also claims that GARM members expressed concerns about Musk\u2019s handling of the<a href=\"https:\/\/nypost.com\/2023\/06\/01\/hunter-biden-laptop-photo-archive-published-on-new-website\/\"> Hunter Biden laptop<\/a> story on Twitter. Missouri<\/a>, the justices ruled the plaintiffs didn\u2019t have legal standing to bring their case.<\/p>\n\n\n\n<p>The ruling reversed decisions by two lower courts, which held that when the government \u201ccoerced\u201d or \u201csignificantly encouraged\u201d the platforms to moderate content related to <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\">COVID-19<\/a>, presidential elections and other controversial topics, they transformed the social media companies\u2019 decisions into state action, violating plaintiffs\u2019 First Amendment rights.<\/p>\n\n\n\n<p>Commenting on today\u2019s decision, Children\u2019s Health Defense (CHD) CEO Mary Holland said she \u201cis deeply disappointed\u201d in the court\u2019s decision to reverse the preliminary injunction \u201cthat the Western District of Louisiana granted and the 5th Circuit affirmed.\u201d<\/p>\n\n\n\n<p>Holland said, \u201cWe consider the government\u2019s role in coercing and encouraging censorship by social media platforms the greatest threat to free speech in our time.\u201d<\/p>\n\n\n\n<p>CHD and its founder and chairman on leave Robert F. Kennedy Jr. in March 2023 made similar allegations against the Biden administration in a <a href=\"https:\/\/childrenshealthdefense.org\/defender\/lawsuit-rfk-jr-chd-biden-free-speech\/\">class action lawsuit<\/a> filed on behalf of all American news consumers.<\/p>\n\n\n\n<p>A federal judge in July 2023 <a href=\"https:\/\/childrenshealthdefense.org\/defender\/chd-lawsuit-consolidate-censorship-big-tech\/\">consolidated the two lawsuits<\/a>, which allowed them to have shared processes for discovery.<\/p>\n\n\n\n<p>Plaintiffs in <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/RFK-Jr-et-al-v-Biden-Complaint-3_24_23.pdf\">Kennedy et al. v. Biden et al.<\/a> also requested and were granted a <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/2.14.2024-Memorandum-Ruling-on-PI.pdf\">preliminary injunction<\/a> by the same judge, Terry Doughty, prohibiting key Biden administration officials and agencies from coercing, significantly encouraging, or taking joint action with social media platforms to suppress or censor online content.<\/p>\n\n\n\n<p>However, Judge Doughty simultaneously issued a stay on the injunction until 10 days after the Supreme Court ruling in Murthy v. Missouri.<\/p>\n\n\n\n<p>Holland said that CHD and Kennedy don\u2019t face the same problem of standing as some of the plaintiffs in Murthy v. Missouri and that Kennedy v. Missouri (formerly Missouri v. Biden), barring several federal agencies and Biden administration officials from engaging in those actions until the lawsuit was decided.<\/p>\n\n\n\n<p>Then the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/biden-administration-first-amendment-violated-social-media-censorship\/\">5th Circuit U.S. Court of Appeals<\/a> narrowed but upheld what Justice Amy Coney Barrett, writing for the majority, called a \u201csweeping preliminary injunction,\u201d in September 2023.<\/p>\n\n\n\n<p>\u201cThe Fifth Circuit,\u201d Barrett wrote, \u201cwas wrong to do so.\u201d<\/p>\n\n\n\n<p>The plaintiffs in Murthy v. Missouri \u2014 the states of Missouri and Arkansas, Drs. <a href=\"https:\/\/childrenshealthdefense.org\/defender\/jay-bhattacharya-lee-fang-government-censorship-social-media\/\">Jay Bhattacharya<\/a>, <a href=\"https:\/\/childrenshealthdefense.org\/defender\/defender-in-depth-martin-kulldorff-great-barrington-declaration-public-health\/\">Martin Kulldorff<\/a> and <a href=\"https:\/\/childrenshealthdefense.org\/defender\/mind-control-social-media-censorship\/\">Aaron Kheriaty<\/a>, The Gateway Pundit\u2019s <a href=\"https:\/\/www.thegatewaypundit.com\/2023\/07\/breaking-independence-day-victory-free-speech-federal-judge\/\">Jim Hoft<\/a> and health activist Jill Hines \u2014 argued that the censorship they experienced on social media could be tied to government action and that they are likely to be censored in the future.<\/p>\n\n\n\n<p>Barrett disagreed, writing that social media companies have long-standing content moderation policies and plaintiffs didn\u2019t show \u201cspecific causation\u201d for discrete instances of content moderation tied to the government, nor did they demonstrate a substantial risk that \u201cin the near future they will suffer an injury that is traceable to a Government defendant and redressable by the injunction they seek.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"670\" height=\"573\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/09\/image-11.png\" alt=\"\" class=\"wp-image-4850\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/09\/image-11.png 670w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/09\/image-11-300x257.png 300w\" sizes=\"auto, (max-width: 670px) 100vw, 670px\" \/><\/figure>\n\n\n\n<p>The court did concede that the federal government played a role in the content decisions, but maintained the relationship was more complex than the lower court rulings accounted for when they \u201cglossed over complexities in the evidence\u201d.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-411_3dq3.pdf\">Barrett wrote<\/a>:<\/p>\n\n\n\n<p>\u201cThe platforms had independent incentives to moderate content and often exercised their own judgment. To be sure, the record reflects that the Government defendants played a role in at least some of the platforms\u2019 moderation choices. But the Fifth Circuit, by attributing every platform decision at least in part to the defendants, glossed over complexities in the evidence.\u201d<\/p>\n\n\n\n<p>Barrett added that the lower court erred in \u201ctreating the defendants, plaintiffs, and platforms each as a unified whole,\u201d and that instead, each plaintiff must demonstrate their own standing for each claim against each defendant.<\/p>\n\n\n\n<p><a href=\"https:\/\/x.com\/JeninYounesEsq\/status\/1805981644437819866\">Jenin Younes<\/a>, an attorney for the plaintiffs, tweeted, \u201cWhile disappointing, the decision is not devastating.\u201d She said the underlying case will continue. \u201cThis fight is not over!!\u201d<\/p>\n\n\n\n<p><strong>Alito dissents, \u2018It was blatantly unconstitutional\u2019<\/strong><\/p>\n\n\n\n<p>Justice Samuel A. Alito Jr. dissented, joined by Justices Clarence Thomas and Neil M. Gorsuch.<\/p>\n\n\n\n<p>In his dissenting opinion, Alito called the case \u201cone of the most important free speech cases to reach this Court in years.\u201d<\/p>\n\n\n\n<p>He criticized the court for failing to address the underlying free speech questions at stake in the case and said that if any of the plaintiffs had standing \u2014 which he argued Hines did \u2014 the court was obligated to address the merits of the case.<\/p>\n\n\n\n<p>\u201cThe Court, however, shirks that duty and thus permits the successful campaign of coercion in this case to stand as an attractive model for future officials who want to control what the people say, hear, and think,\u201d Alito wrote.<\/p>\n\n\n\n<p>He added that the extensive record plainly shows the administration coerced social media companies to comply with their wishes and suppress speech. \u201cIt was blatantly unconstitutional, and the country may come to regret the Court\u2019s failure to say so.\u201d<\/p>\n\n\n\n<p>What Alito called the \u201cvast\u201d record of evidence shows that some federal officials communicated with social media platforms about so-called \u201cmisinformation\u201d on their websites, instructing the platforms to remove some content and some media accounts.<\/p>\n\n\n\n<p>In response, the platforms created an expedited reporting system, removed certain content, and banned specific users from their websites. The platforms also modified their content policies to capture more posts and continued to remain in contact with these officials.<\/p>\n\n\n\n<p>Relevant to the Kennedy v. Biden case, that record includes specific evidence the Biden officials sought to censor tweets by Kennedy.<\/p>\n\n\n\n<p>For example, the White House specifically targeted Kennedy\u2019s Jan. 22, 2021, tweet about the then-recent <a href=\"https:\/\/twitter.com\/robertkennedyjr\/status\/1352748139665645569\">death of baseball Hall of Famer Hank Aaron<\/a>, 18 days after he publicly received the Moderna vaccine.<\/p>\n\n\n\n<p><em>The Defender on occasion posts content related to Children\u2019s Health Defense\u2019s nonprofit mission that features Mr. Kennedy\u2019s views on the issues CHD and The Defender regularly cover. U.S.<\/em><\/p>\n\n\n\n<p>The COVID-19 vaccines carry a much higher risk of blood clots in the brain compared with other vaccines, according to a new <a href=\"https:\/\/www.preprints.org\/manuscript\/202406.1236\/v2\">study<\/a> by Dr. Peter McCullough and colleagues.<\/p>\n\n\n\n<p>The researchers looked at reports in the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/cdc-mandy-cohen-wake-forest-graduation-speech\/\">Centers for Disease Control and Prevention<\/a>\u2019s (CDC) <a href=\"https:\/\/vaers.hhs.gov\/\">Vaccine Adverse Event Reporting System<\/a> (VAERS) from January 1990 through December 2023.<\/p>\n\n\n\n<p>They counted the number of cerebral thromboembolism events \u2014 as in, blood clots of the brain\u2019s veins or arteries \u2014 reported in people who received a <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\">COVID-19<\/a> shot compared with those who received a flu shot or other <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/toxic-exposures\/\">vaccines<\/a>.<\/p>\n\n\n\n<p>Blood clots that block blood flow to the brain account for roughly <a href=\"https:\/\/www.stroke.org\/en\/about-stroke\/types-of-stroke\/ischemic-stroke-clots\">87% of all strokes<\/a>, according to the American Stroke Association, a division of the American Heart Association.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.petermcculloughmd.com\/\">McCullough<\/a> \u2014 a cardiologist with over 1,000 publications and over 685 citations in the National Library of Medicine \u2014 told <a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a> the study showed \u201can unacceptable risk of catastrophic thrombotic injuries to the brain\u201d in individuals who took one or more COVID-19 shots.<\/p>\n\n\n\n<p>McCullough summarized the study\u2019s results on <a href=\"https:\/\/petermcculloughmd.substack.com\/p\/breaking-publication-covid-19-vaccines\">Substack<\/a>:<\/p>\n\n\n\n<p>\u201cCompared to influenza vaccines given over 34 years, COVID-19 vaccines in 36 months of use had over 1000-fold increased risk of most blood clot events, and compared to all vaccines combined administered over 34 years, this risk remained at over 200-times greater with COVID-19 vaccination.\u201d<\/p>\n\n\n\n<p>Prior research has suggested that the spike protein in both the <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/37393180\/\">SARS-CoV-2 virus<\/a> and the COVID-19 vaccine can cause serious <a href=\"https:\/\/childrenshealthdefense.org\/defender\/covid-vaccines-linked-deadly-abdominal-blood-clotting\/\">blood clotting<\/a>, McCullough and his co-authors noted in their report.<\/p>\n\n\n\n<p>Blood clots in the brain are difficult to treat, McCullough told The Defender, and \u201coftentimes leave patients with devastating disabilities.\u201d<\/p>\n\n\n\n<p>\u201cThis and <a href=\"https:\/\/childrenshealthdefense.org\/defender\/vaxxed-covid-patients-death-rate-unvaxxed-study\/\">other sources of data<\/a>,\u201d he added, \u201csupport calls to <a href=\"https:\/\/childrenshealthdefense.org\/defender\/scientists-global-moratorium-mrna-vaccines-removal-childhood-schedule\/\">remove all COVID-19 vaccines<\/a> from public use.\u201d<\/p>\n\n\n\n<p>The study \u2014 co-authored with Claire Rogers, <a href=\"https:\/\/childrenshealthdefense.org\/defender\/pharmacies-paid-reject-ivermectin-push-covid-shots\/\">Dr. James Thorp<\/a> and Kirstin Cosgrove \u2014 is under peer review and available online as a <a href=\"https:\/\/www.preprints.org\/manuscript\/202406.1236\/v2\">preprint<\/a>.<\/p>\n\n\n\n<p><strong>Women especially at risk<\/strong><\/p>\n\n\n\n<p>For the study, McCullough and his co-authors used 12 search terms to find VAERS reports of adverse events related to blood clots in the brain: <a href=\"https:\/\/my.clevelandclinic.org\/health\/diseases\/23520-cavernous-sinus-thrombosis\">cavernous sinus thrombosis<\/a>, <a href=\"https:\/\/www.verywellhealth.com\/middle-cerebral-artery-stroke-3146460\">cerebral artery thrombosis<\/a>, <a href=\"https:\/\/www.mayoclinic.org\/diseases-conditions\/stroke\/diagnosis-treatment\/drc-20350119\">cerebral infarction<\/a>, cerebral thrombosis, <a href=\"https:\/\/www.hopkinsmedicine.org\/health\/conditions-and-diseases\/cerebral-venous-sinus-thrombosis\">cerebral venous sinus thrombosis<\/a>, <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/books\/NBK459315\/\">cerebral venous thrombosis<\/a>, embolic cerebral infarction, ischaemic cerebral infarction, sigmoid sinus thrombosis, superior sagittal sinus thrombosis, thrombotic cerebral infarction and <a href=\"https:\/\/www.medicalnewstoday.com\/articles\/transverse-sinus-thrombosis\">transverse sinus thrombosis<\/a>.<\/p>\n\n\n\n<p>In the three years since the COVID-19 vaccine rollout, they found 5,137 reports of a brain blood clot event in those who received one or more COVID-19 shots.<\/p>\n\n\n\n<p>Meanwhile, VAERS data showed only 52 reports since 1990 of a brain blood clot event following a flu vaccine and 282 since 1990 following all other vaccinations, they said.<\/p>\n\n\n\n<p>The actual number of events may be higher due to <a href=\"https:\/\/childrenshealthdefense.org\/defender\/vaers-undercounting-deaths-after-covid-shots\/\">underreporting in VAERS<\/a>, they said, for several reasons.<\/p>\n\n\n\n<p>First, CDC staff may have \u201ctremendous difficulty\u201d in processing the reports due to an <a href=\"https:\/\/www.israelnationalnews.com\/news\/309030\">overwhelming increase<\/a> in <a href=\"https:\/\/childrenshealthdefense.org\/defender\/children-died-covid-shots-much-higher-vaers-reports-indicate\/\">VAERS reports<\/a> since the COVID-19 vaccine rollout.<\/p>\n\n\n\n<p>Also, clinicians may not have the necessary awareness and knowledge to recognize injuries as being vaccine-related and thus may not report them in VAERS.<\/p>\n\n\n\n<p>Moreover, they added, \u201cThe VAERS database is well known for its difficulty in entering events, making it even more challenging for <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/health-conditions\/\">healthcare<\/a> workers to submit each event with limited time in a hospital or clinic setting.\u201d<\/p>\n\n\n\n<p>The authors said their findings are especially concerning for women of reproductive age \u2014 who are particularly at risk for certain blood clotting events in the brain, such as cerebral venous thrombosis.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.ahajournals.org\/doi\/10.1161\/STR.0000000000000456\">American Heart Association<\/a> said in a Jan. 29 review article that roughly two-thirds of all cerebral venous thrombosis cases occurred in women of reproductive age.<\/p>\n\n\n\n<p>Given this reality, the study\u2019s authors called for \u201can immediate global <a href=\"https:\/\/www.preprints.org\/manuscript\/202406.1236\/v2\">moratorium on the use of COVID-19 vaccines<\/a> \u2026 with an absolute contraindication in women of reproductive age.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>CDC: no plan to change COVID vaccine recommendations<\/strong><\/h2>\n\n\n\n<p>The Defender asked the CDC if it planned to alter its COVID-19 vaccination recommendations in light of McCullough and his co-authors\u2019 findings.<\/p>\n\n\n\n<p>A CDC spokesperson told The Defender, the \u201cCDC does not comment on findings or claims by individuals or organizations outside of CDC. Current CDC recommendations can be found <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/vaccines\/stay-up-to-date.html\">here<\/a>.\u201d<\/p>\n\n\n\n<p>The CDC has found the COVID-19 vaccines to be safe and effective, the spokesperson said. \u201cThe CDC continues to encourage Americans to get vaccinated, as the COVID-19 vaccination continues to be the best way to protect against serious illness.\u201d<\/p>\n\n\n\n<p>When asked specifically about the risks of COVID-19 vaccination for women of reproductive age, the CDC spokesperson directed The Defender to the CDC\u2019s webpage <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/vaccines\/recommendations\/pregnancy.html\">COVID-19 Vaccines While Pregnant or Breastfeeding<\/a>, which states that the vaccines are safe and effective.<\/p>\n\n\n\n<p>A <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/20240625-Complaint-%E2%80%94-Moms-v.-Becerra.Doc-01-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> filed Tuesday seeks to strike down the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/prep-act-covid-vaccine-injury-liability\/\">PREP Act<\/a> \u2014 the federal law that granted legal immunity to companies such as Pfizer and Moderna for injuries caused by their COVID-19 vaccines and other COVID-19 countermeasures.<\/p>\n\n\n\n<p>The lawsuit, filed in the U.S. District Court for the Middle District of Florida, Tampa Division, alleges the <a href=\"https:\/\/aspr.hhs.gov\/legal\/PREPact\/Pages\/default.aspx\">Public Readiness and Emergency Preparedness (PREP) Act<\/a> violates the U.S. Constitution and the <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-administrative-procedure-act\">Administrative Procedure Act<\/a>, which governs how federal agencies develop and issue regulations.<\/p>\n\n\n\n<p>Plaintiffs in the suit include the nonprofit <a href=\"https:\/\/momsforamerica.us\/\">Moms for America<\/a> and individual plaintiffs who were injured by a <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\">COVID-19<\/a> vaccine, or whose loved one suffered injury or death from a COVID-19 vaccine.<\/p>\n\n\n\n<p>According to the <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/20240625-Complaint-%E2%80%94-Moms-v.-Becerra.Doc-01-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a>, \u201cThis case is about the government\u2019s failure to resolve conflicts involving Americans killed or grievously harmed while receiving healthcare during the COVID-19 pandemic.\u201d<\/p>\n\n\n\n<p>Defendants are the U.S. Department of Health and Human Services (HHS), the U.S. Health Resources and Services Administration, HHS Secretary Xavier Becerra and President Joe Biden.<\/p>\n\n\n\n<p>\u201cAs even <a href=\"https:\/\/www.nytimes.com\/2024\/05\/03\/health\/covid-vaccines-side-effects.html\">The New York Times<\/a> has recently acknowledged,\u201d <a href=\"https:\/\/smartbizlaw.com\/our-team\/\">Jeff Childers<\/a>, attorney for the plaintiffs, told <a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a>, \u201ctoo many Americans have been injured by the COVID <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/toxic-exposures\/\">vaccines<\/a> and other rushed treatments, and now have no recourse, no help and no support. They can\u2019t sue anybody, thanks to PREP.\u201d<\/p>\n\n\n\n<p>\u201cPREP was poorly conceived, badly executed, and gave far too much power to unelected bureaucrats and <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/agency-capture\/\">executive agencies<\/a>,\u201d he added.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.coffeeandcovid.com\/p\/unprepared-wednesday-june-26-2024\">Childers wrote on Substack<\/a> today that the PREP Act should \u201cbe crushed and burned to a cinder in the incinerator of history\u2019s worst ideas.\u201d<\/p>\n\n\n\n<p>The lawsuit asks the court to declare the PREP Act unconstitutional and to declare that the HHS secretary\u2019s actions in implementing the act violate the Administrative Procedure Act.<\/p>\n\n\n\n<p>The suit also asks the court to declare that the plaintiffs can sue companies like Pfizer and Moderna in federal and state courts. It also seeks compensation for attorney fees.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>COVID revealed how bad PREP Act is for Americans<\/strong><\/h2>\n\n\n\n<p>In 2005, Congress passed the PREP Act in a defense appropriations bill after then-President George W. Bush gave a \u201cpassionate speech about the nation\u2019s lack of preparation for biowarfare and pandemics,\u201d Childers told The Defender.<\/p>\n\n\n\n<p>The PREP Act authorizes the HHS secretary to declare that \u201ca disease or other <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/health-conditions\/\">health condition<\/a> or other threat to health<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/247d-6d\"> constitutes a public health emergency<\/a>.\u201d It also grants a \u201ccovered person\u201d <a href=\"https:\/\/childrenshealthdefense.org\/defender\/prep-act-covid-vaccine-injury-liability\/\">immunity from legal liability<\/a> for all claims for loss relating to the administration or use of \u201ccountermeasures,\u201d such as drugs, biological products, medical devices and vaccines.<\/p>\n\n\n\n<p>\u201cBefore COVID,\u201d Childers said, \u201cit was barely used.\u201d<\/p>\n\n\n\n<p>Kim Mack Rosenberg, general counsel for <a href=\"https:\/\/childrenshealthdefense.org\/\">Children\u2019s Health Defense<\/a>, told The Defender the COVID-19 pandemic has \u201cshined a bright light\u201d on the PREP Act.<\/p>\n\n\n\n<p>\u201cI think it is safe to say,\u201d she said, \u201cmost Americans had no idea that as COVID vaccines were developed and rolled out at \u2018warp speed\u2019 \u2014 and in many instances mandated or taken by individuals based on fear-mongering \u2014 and as medications such as <a href=\"https:\/\/childrenshealthdefense.org\/defender\/medical-coder-covid-hospital-protocol-deaths\/\">remdesivir<\/a> were forced on many patients, that if they were harmed or died as a result of these interventions they would be essentially left with no remedy.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"538\" height=\"539\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/11\/image.png\" alt=\"\" class=\"wp-image-5325\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/11\/image.png 538w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/11\/image-300x300.png 300w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/11\/image-150x150.png 150w\" sizes=\"auto, (max-width: 538px) 100vw, 538px\" \/><\/figure><\/div>\n\n\n<p>The PREP Act set up the <a href=\"https:\/\/www.hrsa.gov\/cicp\/cicp-vicp\">Countermeasures Injury Compensation Program<\/a> (CICP) court where those injured by COVID-19 countermeasures can bring their claims.<\/p>\n\n\n\n<p>Injuries related to vaccines that are not considered countermeasures to a public health emergency are handled by the <a href=\"https:\/\/www.hrsa.gov\/vaccine-compensation\/about\">National Vaccine Injury Compensation Program<\/a> and its court, according to the <a href=\"https:\/\/www.congress.gov\/bill\/99th-congress\/house-bill\/5546\">National Childhood Vaccine Injury Act of 1986<\/a>.<\/p>\n\n\n\n<p>Childers called the CICP court an \u201cunconstitutional shadow court\u201d in which \u201ca secret bureaucracy denies 99% of claims and awards the \u2018lucky few\u2019 with pennies on the dollar.\u201d<\/p>\n\n\n\n<p>As of June 1, CICP had received <a href=\"https:\/\/www.hrsa.gov\/cicp\/cicp-data\">13,773 claims<\/a> and issued decisions for only 3,363 of those claims. The program denied 3,271 of the claims.<\/p>\n\n\n\n<p>Thirteen of the <a href=\"https:\/\/www.hrsa.gov\/cicp\/cicp-data\/table-4\">claims awarded<\/a> were for injuries suffered from a COVID-19 vaccine. Less than $10,000 was awarded for each of the claims, with the total payout for all 13 claims amounting to less than $50,000.<\/p>\n\n\n\n<p>\u201cIn other words,\u201d he said, \u201cPREP cuts normal Constitutional courts out of the process, replacing them with a poor, unconstitutional substitute.\u201d<\/p>\n\n\n\n<p>PREP has already done \u201cmassive damage,\u201d Childers said, \u201cby turning normal commercial incentives inside-out and deleting due process.\u201d<\/p>\n\n\n\n<p>He added, \u201cWe must get help to millions of people discarded by the system, and prevent this disaster from ever happening again.\u201d<\/p>\n\n\n\n<p>The Florida lawsuit calls out CICP\u2019s \u201cbreathtakingly short\u201d one-year statute of limitations for:<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"623\" height=\"1024\" src=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-23-623x1024.png\" alt=\"\" class=\"wp-image-4602\" srcset=\"http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-23-623x1024.png 623w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-23-182x300.png 182w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-23-768x1263.png 768w, http:\/\/humanityandearth.com\/wp\/wp-content\/uploads\/2023\/08\/image-23.png 843w\" sizes=\"auto, (max-width: 623px) 100vw, 623px\" \/><\/figure><\/div>\n\n\n<p>\u201cInjuries caused by unknown, unknowable, and non-existent vaccine products and technologies. Even to receive program compensation, the Act requires causation to be proved based on established science for those same novel products and technologies. Most medical studies take years to conduct, be drafted, be peer-reviewed, and to be published. It is irrational to believe that a person taking a covered countermeasure could possibly have access to published medical\/scientific studies within the one-year statute of limitation.\u201d<\/p>\n\n\n\n<p><strong>Lawsuit is 1 of 3 suits challenging PREP Act<\/strong><\/p>\n\n\n\n<p>Childers\u2019 lawsuit is one of three active cases challenging the PREP Act, according to attorney <a href=\"https:\/\/childrenshealthdefense.org\/authors\/ray-l-flores-ii-esq\/\">Ray Flores<\/a> who on May 31 filed a separate <a href=\"https:\/\/childrenshealthdefense.org\/defender\/george-watts-jr-pfizer-covid-vaccine-injury\/\">lawsuit against the U.S. Department of Defense<\/a> (DOD), which oversaw the development and distribution of the drug under<a href=\"https:\/\/childrenshealthdefense.org\/defender\/operation-warp-speed-big-payouts-pharma-execs\/\"> Operation Warp Speed<\/a>.<\/p>\n\n\n\n<p>In addition to the suits filed by Childers and Flores, <a href=\"https:\/\/childrenshealthdefense.org\/defender\/lawsuit-covid-vaccine-injury-liability-manufacturers\/\">attorney Aaron Siri in October 2023 sued HHS<\/a> and other government agencies on behalf of <a href=\"https:\/\/react19.org\/about\">React19<\/a> \u2014 an advocacy group whose 36,000-plus members were<a href=\"https:\/\/childrenshealthdefense.org\/defender\/covid-vaccine-injuries-global-campaign-canwetalkaboutit\/\"> injured by the COVID-19 vaccines<\/a> \u2014 and eight vaccine-injured individuals.<\/p>\n\n\n\n<p>Flores told The Defender, \u201cThe PREP Act and the Department of Defense\u2019s Operation Warp Speed are indeed acts of war on our own \u2014 hundreds of thousands of civilian casualties, violations of the <a href=\"https:\/\/www.nejm.org\/doi\/full\/10.1056\/NEJM199711133372006\">Nuremberg Code<\/a>, and essentially no monetary recourse for their experimenting on humanity at large.\u201d<\/p>\n\n\n\n<p>Flores added, \u201cI applaud Mr. Siri and Mr. Childers for raising awareness with the public, with the courts, on Capitol Hill and in the press.\u201d<\/p>\n\n\n\n<p>When the Defender reached out to HHS for comment on the lawsuit, an HHS spokesperson who chose to remain anonymous said the agency cannot comment on ongoing litigation.<\/p>\n\n\n\n<p>The Defender reached out to the White House for comment on the suit but did not receive a response by deadline.<\/p>\n\n\n\n<p>A federal court on Thursday ordered the U.S. Food and Drug Administration (FDA) to respond to a series of questions, as part of an ongoing lawsuit <a href=\"https:\/\/childrenshealthdefense.org\/\">Children\u2019s Health Defense<\/a> (CHD) filed against the agency to obtain documents related to reports on COVID-19 vaccine injuries in the Vaccine Adverse Event Reporting System (<a href=\"https:\/\/vaers.hhs.gov\/\">VAERS<\/a>) database.<\/p>\n\n\n\n<p><a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/dc-foia-lawsuit-FDA.pdf\">CHD sued the FDA<\/a> in January 2023 for records of the data-mining analysis the agency conducted to identify safety signals in VAERS that might indicate links between the <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/covid\/\">COVID-19<\/a> shots and adverse events.<\/p>\n\n\n\n<p>CHD originally requested the information as part of a Freedom of Information Act (FOIA) request filed in July 2022, and denied by the FDA in October 2022.<\/p>\n\n\n\n<p>The lawsuit alleged the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/chd-lawsuit-fda-vaers-covid-vaccine-injuries-deaths\/\">FDA violated provisions of the FOIA<\/a> by refusing to provide key analysis of reports in VAERS.<\/p>\n\n\n\n<p>The FDA claimed the records are fully exempt from disclosure under FOIA. The <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/agency-capture\/\">agency<\/a> later claimed it was overwhelmed by a high number of COVID-19 vaccine-related FOIA requests.<\/p>\n\n\n\n<p><a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/17-1.pdf\">The FDA filed a motion<\/a> in September 2023 requesting a <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fda-stonewalls-chd-covid-vaccine-safety-data\/\">stay of the lawsuit\u2019s proceedings<\/a> for 18 months. In January, the <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/CHD-v.-FDA-Order-on-Motion-to-Stay.pdf\">court granted the stay<\/a>.<\/p>\n\n\n\n<p>In Thursday\u2019s order, delivered via email to CHD and FDA attorneys, <a href=\"https:\/\/www.dcd.uscourts.gov\/content\/district-judge-randolph-d-moss\">Judge Randolph D. Moss<\/a> of the U.S. District Court for the District of Columbia ordered the FDA to file a status report by Aug. 9, providing information including whether an overlap exists between the documents CHD requested and documents requested in other FOIA requests the FDA is processing.<\/p>\n\n\n\n<p>Moss also ordered the FDA to provide its best estimate of when it can begin processing CHD\u2019s FOIA request, and to outline the steps it has taken \u201cto seek redress regarding the burdens\u201d the agency faces due to the FOIA requests it is responding to, including the hiring of new employees for this purpose.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/minute-order-fda.jpg\" alt=\"\" class=\"wp-image-307990\"\/><\/figure>\n\n\n\n<p>CHD will have 10 days after the FDA files its status report to respond, after which the court will decide whether to renew the existing stay or to order the FDA to begin processing CHD\u2019s FOIA request.<\/p>\n\n\n\n<p>Ray Flores, senior outside counsel for CHD, told <a href=\"https:\/\/childrenshealthdefense.org\/defender\/\">The Defender<\/a> he is \u201cpleased to see the court put it upon the FDA to develop or at least explain its plan, since endless delays appear to be no longer be acceptable.\u201d<\/p>\n\n\n\n<p>Flores added:<\/p>\n\n\n\n<p>\u201cThe FDA\u2019s response to vaccine-related FOIA requests has essentially remained at a standstill. The court took CHD\u2019s arguments to heart that a proactive solution must be found to end this gridlock.<\/p>\n\n\n\n<p>\u201cBy issuing this order the court sent a message that the public has a right to access such information and that an agency\u2019s workload cannot stop the free flow of that information to the public.\u201d<\/p>\n\n\n\n<p><strong>FDA slow-walking release of FOIA documents, claiming it is overwhelmed by requests<\/strong><\/p>\n\n\n\n<p>As part of its July 2022 FOIA request, CHD also requested records of any FDA review of Serious Adverse Events of Special Interest, records of the FDA\u2019s communications with VAERS staff and the Centers for Disease Control and Prevention (CDC) about the CDC\u2019s own COVID-19 vaccine safety monitoring, and records of follow-up investigations of safety signals.<\/p>\n\n\n\n<p>In October 2022, the FDA claimed the records CHD sought were fully exempt from disclosure under FOIA laws because they contained \u201copinions, recommendations and policy discussions\u201d protected by law and attorney-client privilege.<\/p>\n\n\n\n<p>CHD appealed the FDA\u2019s decision in November 2022 and sued the agency after the FDA said that it needed six months to a year \u2014 a period far exceeding the time limit specified by FOIA \u2014 to respond to the appeal.<\/p>\n\n\n\n<p>In status reports jointly filed by CHD and the FDA in <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/May-JSR.pdf\">May<\/a> and <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/June-JSR-.pdf\">June<\/a> 2023, the FDA said it had located 150 records related to the data mining and was still working on locating records related to the rest of the request.<\/p>\n\n\n\n<p>Instead of providing these records or processing the rest of CHD\u2019s request, the FDA stated in the <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/August-JSR-1.pdf\">August 2023 status report<\/a> that it planned to seek a stay of proceedings, known as an \u201cOpen America\u201d stay.<\/p>\n\n\n\n<p>This led to the FDA\u2019s September 2023 motion for an <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/17-1.pdf\">18-month stay of the proceedings<\/a> in the lawsuit.<\/p>\n\n\n\n<p>In that motion, which <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/chd-fda-19.pdf\">CHD opposed<\/a>, the FDA did not dispute that CHD\u2019s request was <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/legal\/\">legally<\/a> entitled to processing or indicate any problem with the request.<\/p>\n\n\n\n<p>The FDA did not commit to fulfilling CHD\u2019s request after the 18-month stay. Instead, the agency said it would let the court know \u201cwhether it needs additional time before proceeding with this case.\u201d<\/p>\n\n\n\n<p>In October 2023, the FDA claimed it could not fulfill CHD\u2019s FOIA request because it was overwhelmed by an increased number of vaccine-related FOIA requests since 2019, and in particular, by demands to meet the hefty production schedule for disclosing documents related to the <a href=\"https:\/\/phmpt.org\/\">Public Health and Medical Professionals for Transparency<\/a> (PHMPT) lawsuits.<\/p>\n\n\n\n<p>Those <a href=\"https:\/\/phmpt.org\/pfizer-court-documents\/\">lawsuits<\/a> require the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fda-pfizer-documents-vaccine-adverse-events\/\">FDA to release<\/a> all documents related to licensing of the <a href=\"https:\/\/childrenshealthdefense.org\/defender\/childrens-health-defense-sues-fda-pfizer-comirnaty-covid-vaccine\/\">Pfizer-Comirnaty COVID-19 vaccine<\/a>, and have led to the release of what are widely known as the \u201c<a href=\"https:\/\/childrenshealthdefense.org\/defender\/fda-pfizer-covid-vaccine-final-documents-product-safety\/\">Pfizer documents<\/a>.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/childrenshealthdefense.org\/defender\/fda-eight-months-produce-pfizer-safety-data\/\">The FDA<\/a>, which previously claimed, unsuccessfully, that it needed <a href=\"https:\/\/childrenshealthdefense.org\/defender\/fda-75-years-release-pfizer-vaccine-documents\/\">75 years to process the documents<\/a> requested by PHMPT, claimed in October 2023 that the processing of those documents was placing a heavy burden on the agency, as it was compelled to release at least 35,000-55,000 pages per month.<\/p>\n\n\n\n<p>CHD responded that any problem managing its workload \u201cis a <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/chd-fda-19.pdf\">problem of the FDA\u2019s own making<\/a>\u201d in not assigning necessary personnel to the FOIA division of the Center for Biologics Evaluation and Research division that regulates vaccines for human use.<\/p>\n\n\n\n<p>CHD asked the court to require the FDA to process CHD\u2019s request in accordance with the law.<\/p>\n\n\n\n<p>In Thursday\u2019s ruling, the court ordered the FDA to specify \u201chow many FDA employees are dedicated to responding to FOIA requests unrelated to the PHMPT II litigation\u201d and \u201cwhat steps, if any, has the agency taken to seek redress regarding the burdens imposed by [the PHMPT] litigation.\u201d<\/p>\n\n\n\n<p><strong>Documents may shed light on safety signals, investigations into adverse events<\/strong><\/p>\n\n\n\n<p>If and when they are released, the documents CHD requested may shed light on some statistical safety signals, regarding certain types of serious adverse events related to the COVID-19 shots.<\/p>\n\n\n\n<p>The documents are also expected to provide key insights into follow-up investigations, if any, that the FDA should be conducting in collaboration with the CDC on the potential safety signals and reports of serious adverse events.<\/p>\n\n\n\n<p>More than <a href=\"https:\/\/medalerts.org\/vaersdb\/findfield.php?TABLE=ON&amp;GROUP1=AGE&amp;EVENTS=ON&amp;VAX%5b%5d=COVID19&amp;VAX%5b%5d=COVID19-2\">1.6 million adverse events<\/a> following COVID-19 vaccination have been reported to VAERS in the less than three years since the first shots were made available in mid-December 2020.<\/p>\n\n\n\n<p>However, VAERS is likely undercounting the total number of adverse events and <a href=\"https:\/\/childrenshealthdefense.org\/defender_category\/health-conditions\/\">deaths<\/a> following COVID-19 vaccination.<\/p>\n\n\n\n<p>Last month, analyst <a href=\"https:\/\/childrenshealthdefense.org\/defender\/vaers-undercounting-deaths-after-covid-shots\/\">Albert Benavides<\/a> presented evidence indicating that numerous deaths following COVID-19 vaccination are \u201chidden\u201d within VAERS and are not part of the official tally.<\/p>\n\n\n\n<p>In November 2023, Benavides presented similar evidence related to <a href=\"https:\/\/childrenshealthdefense.org\/defender\/defender-in-depth-podcast-albert-benavides\/\">VAERS figures regarding serious adverse events<\/a> following COVID-19 vaccination.<\/p>\n\n\n\n<p>A 2010 <a href=\"https:\/\/digital.ahrq.gov\/sites\/default\/files\/docs\/publication\/r18hs017045-lazarus-final-report-2011.pdf\">Harvard study<\/a> found that <a href=\"https:\/\/childrenshealthdefense.org\/defender\/rfk-jr-david-kessler-covid-vaccine-vaers\/\">less than 1% of all adverse events<\/a> following vaccination are reported to VAERS.<\/p>\n\n\n\n<p>The CDC considers VAERS to be a key \u201c<a href=\"https:\/\/www.cdc.gov\/vaccinesafety\/ensuringsafety\/monitoring\/vaers\/reportingaes.html\">early warning system<\/a>\u201d for detecting unusual or unexpected patterns of adverse event reporting that can signal safety problems with a vaccine, which they are then meant to further investigate.<\/p>\n\n\n\n<h2
